Prosecuting stalkers made easier

Stalking offences are being more successfully prosecuted with less involvement from victims since the introduction of new NSW laws, the state government says.

Stalking acts are a regular occurrence and serious enough to carry a penalty of up to five years in prison, NSW Attorney-General John Hatzistergos says.

Between March and September last year, some 326 people were charged with stalking.

The law was changed in March 2008 to incorporate stalking by mobile phone, text messaging and stalking over the internet.

'The new Act expanded powers for police prosecutors to submit evidence around patterns of behaviour and has resulted in a spike in the number of guilty pleas entered, up from 70 to 88 per cent,' a spokesman for Mr Hatzistergos said in a statement.

'This has had the effect of reducing the number of victims who need to face offenders in court.'

Mr Hatzistergos said people had the right to go about their daily lives without fear of intimidation or harassment.

'These new laws have sent a clear message to would-be stalkers: stalking is a crime and offenders face serious penalties, including up to five years in prison,' Mr Hatzistergos said in a statement.

'By expanding the range of evidence that can be used in prosecutions, the government's new stalking offence has proven to be an effective weapon in convicting more offenders.'

Having long been seen as a company only focused on the whims of buyers, the e-giant is making attempts to mend fences with merchants...................There are those who are skeptical of anything eBay does because of the negative and chaotic changes that have caused undue stress on sellers.

EBay wins court fight against L'Oreal in UK

A British court on Friday ruled that Internet marketplace eBay is not liable for bogus beauty products sold on its Web site, dealing a blow to cosmetics company L'Oreal's campaign against the online auction giant.

L'Oreal SA has taken eBay Inc. to court across Europe, suing in Britain, Germany, France, Belgium and Spain over the sale of fake fragrances and cosmetics on the site.

L'Oreal claims there is an increasing volume of counterfeit goods being sold on eBay. The online auctioneer said negotiations between the companies on the issue broke down because L'Oreal was being unreasonable.

Justice Richard David Arnold ruled in London's High Court that eBay Europe was not liable for trademark infringements committed by its users.

EBay said in a statement that the British ruling was "a victory for consumers and the thousands of entrepreneurs who sell legitimate goods on eBay every day."

A call placed with L'Oreal's London office seeking comment was not immediately returned.

Earlier this month, a French court ordered L'Oreal and eBay to settle their differences, giving them until May 25 to come up with a mediated settlement. Other cases elsewhere in Europe are still pending.

That's a superb article. By contrasting the two sellers and what they can afford to do, and the type of items they're selling and the type of profit they need, and the way in which one seller isn't so badly affected if buyers pay late but the other is, the polar ends of eBay's strategy is shown.

I particularly like these comments...seems it's not only me who has read the user agreement, and hit the back button faster than speedy gonzales

Consumer comments:

Of course people are reluctant to allow a company this poorly run to have access to their bank accounts and credit card information.

There is also the probability that potential users actually are reading through the User Agreement and giving it a firm pass. Any venue that basically states that they may do anything they please for any reason they concoct with your funds and information is pretty scary.

PayPal has a long history of being user-unfriendly. You seem like a nice enough kid, Fred, so do yourself a favor and Google the search term "PayPal", and skim through the first 20 complaints and scandals that seem interesting to you.

The idea seems great, but from the bad experiences I've heard from some users first-hand, I've decided up until now not to use their service

The last comment in particular I can totally relate to....until I stop seeing horror stories on the net, and Paypal sign the EFT Code, and walk the way they talk, then I'm unlikely to 'give em a go'.  Such a shame, Ebay decided to hold 'Choice' of Payment systems ransom....they'd be doing well now, if they'd stayed the hell out of the buyer/seller relationship, and concentrated on getting rid of shonkly sellers.  ho hum......thick as two short planks.
