That was a good listen, tell me something, why does Kurt need two phones being in Montello? Me and Kurt had a falling out in the last part of January. Long story sorta.

I had one of his phones for about two weeks. That's just part of the long story.
Also That Taylina chick threatened me to file a police report against me because of the phone is in his Daughter's name.

I told her to go ahead and do it, and I said to her I should drop Kurt's phone off to the West Wendover Police and file a report on Kurt for (Non Payment for the use of my front loader that he never paid me for-for moving snow. Taylina was real quiet after that. P.s. I should've snooped into that phone and read his text messages, but I didn't..

I looked her up on instagram and found her mothers post. In it she wrote how her daughter had gotten to the place and called her and and said that the other 6 girls (her friends) were not there yet. After that, the mother was busy with her grandchildren and forgot to call her daughter back. After hearing a lot of different theories of how her daughter died, it was revealed that the boy that came in the room tried to r**e her daughter and then after her daughter tried to fight back, she was shot in the private area. I hope she gets justice. This is truly a disturbing and heartbreaking case.

Judge: McFarland’s competency unclear

ELKO — Logan McFarland’s competency to stand trial is still in question.

McFarland, 24, is charged with seven felonies including attempted kidnapping, robbery with the use of a deadly weapon, and grand larceny of a motor vehicle for allegedly stealing a vehicle in Utah Dec. 31 with co-defendant Angela Hill, driving to West Wendover and attempting to steal West Wendover resident Rattanaphorn Keomanivong’s vehicle with her inside.

McFarland is also believed to be tied to the murder of a Mount Pleasant, Utah, couple.

Despite undergoing a 45 minute competency evaluation at Lake’s Crossing in Reno earlier this year, and hearing sworn testimony in district court Tuesday from the two psychologists who performed the evaluation — all deeming McFarland competent, District Judge Nancy Porter said more time was needed to determine whether McFarland should continue being evaluated, or whether he was competent to continue with his trial.

Public Defender Gary Woodbury argued McFarland expressed ideas suggesting he was being guided by external influences. Also, during McFarland’s preliminary hearing, Elko County Sheriff Deputy James Mathes testified to McFarland talking about a belief in a clandestine Illuminati conspiracy, and that the Mayan apocalypse was imminent. Woodbury also said McFarland was profoundly depressed and threatened suicide since his arrest.

Woodbury wondered if either psychologist noticed signs of depression, psychosis or other important behaviors.

“Initially he indicated that he was depressed and suicidal pending his legal problems, and that he was set that he would not go to prison, and would do anything to avoid that,” said Catherine Pearson, Lake’s Cross psychologist. “Later on ... he indicated he had a history of feeling depressed.”

McFarland recorded an extensive history of substance abuse including using methamphetamine, during his evaluation at Lake’s Crossing.

“When you are using stimulants and depressants on an on-going basis, you are experiencing tolerance and withdrawal symptoms. It is hard to know what is depression as a mood disorder and what is depression because of withdrawal from the stimulant,” Pearson said.

However, the psychologists made a distinction between someone being competent and having psychotic tendencies.

A defendant could exhibit symptoms of mental health problems, even a diagnosed schizophrenic, could “still be competent to stand trial if the symptoms don’t interfere with competency,” Pearson said.

Lake’s Crossing psychologists were only evaluating McFarland’s competency to understand charges and the legal system.

“During our evaluation he was rational, he was organized, his mood was stable. There was nothing to suggest that he would not be able to proceed with the case,” she said.

But, a competent defendant also has to be able to assist his legal counsel with a defense, which Woodbury said, based on conversation with his client, he didn’t think McFarland was capable of.

Woodbury also said if McFarland’s psychotic overtones were erratic, a 45-minute evaluation might not have been sufficient time to determine whether they were real or malingered.

McFarland’s evaluation essentially ended 45 minutes after it began, when he put his head down and refused to answer any more questions.

Pearson said 45 minutes to an hour is a typical evaluation period. Porter said the hearing was under advisement to decide whether McFarland needed to continue an evaluation or not.
