Professional eBay Sellers Association head Phil Leahy said he believed that eBay should register its local operation as an Australian business. EBay's service in Britain was forced by tax authorities to register itself for Britain's GST-equivalent value-added tax. VAT

LOL.. and pigs might fly.

One poster stated:

"It will be interesting to see whether the ATO uses this information against eBay at all. After all, 1,000 sellers turning over $50,000 means at least $50million in turnover, of which eBay and PayPal probably get their filthy thieving hands on around 10%. That's AU$5million per year THAT WE KNOW OF (and the real figure is much, much higher) that eBay is siphoning out of the Australian economy, without paying a cent in tax or GST."

As we have been told:
As a foreign entity, eBay International is not required to be registered for GST and therefore does not have an ABN (Australian Business Number)," the company's Australian website states.

However!! it appears they DO have an ABN.

Last modified: 02 May 2002
ABN: 52 002 035 485

ABN status: Active from 30 Jun 2001
Entity name: EBAY PTY LTD
Entity type: Australian Private Company
Main business location
State: NSW
Postcode: 2100

Other registrations
GST status: Not currently registered for GST

Interesting don't you think, I highly doubt this ABN belongs to anyone else as eBay would never permit it.

Why are they not registered for GST ?

Having said that:

eBay Australia don't directly charge you anything. All the invoices are from:

eBay International AG
Helvetiastrasse 15/17
3005 Bern
Switzerland

Swiss VAT Number: 508 508
Company Number: CH-035.3.023.263-7

And that's where your money goes when you pay selling fees.

So it's quite plausible that eBay Australia are not making profit, and are probably making a loss on paper. Of course, eBay Inc is making loads of cash.

However.... lol
Regardless of where the invoices come from, they are still technical running a business in Australia?

they must be pulling in a lot more than $50k per year in fees

not that this makes any difference to the point being made but the threshold is now $75k not $50k
and just thought I would point that out in case we have anyone about to enter the wonderful world of small business

I for one am actually glad that eBay dont pay gst on the fees that they collect because if they did they would have to charge gst on the fees and me as a seller would pay 10% higher fees and in turn would have to try and pass that on somehow to the buyer ....you see its never the companies that pay the gst they are just collection agencies for the government , its the consumers that actually pay , the suppliers charge 10% on top of what they would normally charge for their goods or sevice if gst wasnt applicable
eg if as a seller my fee for an item is $5 which ebay currently get 100% of ...if gst was payable they wouldnt change their fees to read $4.55 + 45c gst = $5 it would be $5 + 50c gst = $5.50 so you see its not eBay that is actually getting away with paying its ebay members that arent paying gst on eBay fees

Looking here ebay and trading post turnover is estimated at over $20 billion a year and since ebay is the elephant in the room that means ebay is a conservative over $15 billion turnover.

http://www.heraldsun.com.au/business/ebay-the-trading-post-under-australian-tax-office-scrutiny/story-e6frfh4f-1225898309620

With paypal, final value, listing and shop fees that is Gross income of 8% on turnover. That is ebau income of 1.2 billion dollars ie 120 million dollars in non GST payment and assuming profit of 700 million, very Conservative as only 5 australian employees. That is another 200 million in lost company tax.

Trading post pays GST and TAX , woolworths and DJs every one else is paying their share . Why should ebay sponge of Australians? Effectivily it is stealling over 300/500 million a year from Australian schools, hospitals, pensions, ect .

Ebay should pay tax Not the person selling a boat , car and old computers on ebay and turning over $20 thousand a year, who paid more to buy new than they sell for second hand. Typical ATO chase the defenceless

Bear in mind that it is only "professional" sellers earning an income from their selling that are required to have an ABN, and they are required to collect GST only if their sales exceed a certain amount (it was $50,000 pa, I think). They can also claim back any GST included (or nominally included) in the cost of the goods they purchase to resell. They effectively pay GST only on their profit margin. People disposing of their own junk are not required to be registered businesses or to pay GST.

Small eBay Sellers Should Differentiate Themselves

http://letters.auctionbytes.com/cgi-bin/blog/blog.pl?/comments/2010/8/1281373012.html

You gotta be kidding, has this diamond seller been on another planet, ebay implemented the changes we had to have { in their opinion } at least 2 years ago now, big sellers have been favored ever since.

eBay Fraud Investigations Team Analyst (French)
http://www.siliconrepublic.com/careers-centre/partner/39-ebay/job/110-ebay-fraud-investigations-t

The Analyst will be responsible for:
• Quality document production while ensuring proper service levels and response time for law enforcement requests and other legal processes as directed [Yes, let’s not do anything unless the authorities require it, and then only the minimum required, and never, never, never offer any information gratuitously.]
• Follow-up contact with law enforcement on investigations and cases as directed by the FIT Supervisor [If you can’t hide the fraud, after the fact, you may as well claim that you are helping the authorities]
• Assisting in best practice sharing and procedures for global law enforcement investigations [ie, obfuscate wherever possible to limit the damage to eBay as much as is possible.]
• Assist with responding to hotline calls as needed [Hotline? This certainly is not the line mere eBay users can ring.]
• Help with intake of LE requests/subpoenas as needed [Darn, those subpoenas are a nuisance, and we thought we had that little fraud under the blanket.]

You will notice that this job actually has nothing to do with instigating investigations of fraud by eBay users (or reporting same to the authorities) and certainly has nothing to do with investigating eBay’s blatant aiding and abetting of shill bidding fraud by its many unscrupulous professional sellers on unsuspecting buyers on eBay. It is only about coordinating statutorily required responses to the authorities who may be investigating matters of fraud on eBay—most probably none of which will have been initially reported to those authorities by eBay.

Indeed, I would hypothesize that eBay has never reported a fraud to the authorities, unless that fraud was on them. What a joke this most despised, unscrupulous organization has become.

More fraud on eBay, by eBay, allegedly. Who could believe?

Here is a fascinating article that exposes the total amorality of some (most?) of the people running eBay. There’s an interesting use of the term “grey area”, something like I consider eBay’s “nod, nod, wink, wink” attitude in the area of shill bidding.
http://blogs.digitalpoint.com/entry.php?b=215

By the way, “Shill Bidding on eBay: Case Study #4”, an even better demonstration of eBay’s effectively aiding and abetting of shill bidding fraud at

PayPal Visit?
http://secularright.org/SR/wordpress/?p=4499&cpage=1#comment-18185

Here’s a funny one about the Pope’s forthcoming visit to the UK.

Some discussion about the cost of the visit to the taxpayer, apparently.

There's no real problem here, just get all the papal visitors to charge everything to their PayPal accounts (eBay's PayPal, that is) and then afterwards claim that none of the goods/services ever arrived. That way you can get the goods/services and never have to pay for them.

It's a great system. Being a payer, I'm looking forward to Mastercard/Visa, on behalf of all their underlying financial institutions, also adopting the same simple mediation policy. Of course, I'm not sure how the PayPal merchant payees feel about such machinations. Then, they can always take the matter up with PayPal. Ho, Ho, Ho, ...

Confessions of an ex eBay Top Seller Account Manager

http://blog.auctionbytes.com/cgi-bin/blog/blog.pl?/comments/2010/8/1282099548.html/5/76#1282168287

Another most interesting from-inside eBay story. Does not tell us much that we did not already suspect.

Good article Phillip, it is completely obvious though that this "Erika" is a plant soft spruiking that Ebay overall is a good guy, while lightly "exposing" some minor negatives LOL

While stating much of what we already know she attempts to quanitify it by claiming that she personally tried to legitimately help people while talking out of the other side of her mouth by stating that she helped perpetuate eBay fraud in her capacity as a TSM.

She states openly that Trust and Safety as well as live help is now soley based in India and Malaysia and that they have little to no training and they frequently 'disconnect' when it gets beyond their ken, not only that she also openly stated that eBay has little to no interest in small to medium sellers and have no qualms in eradicating them at a whim.

The fact that when T and S was still based in America she claimed as she walked through the T and S department she noticed that there were signs on every single terminal that read " No touchie John chang" who was/is a massive asian seller that brought an incredible amount of revinue to eBay and thus was 'untouchable' glaringly perpetuates the fact that ebay commits fraud regularly, and as we all correctly assume there must also be "no touchie eBay" signs in every government and consumer complaint department in the world.

Why this company has not been vigorously investigated beggars all belief, but hey welcome to modern corporate life, it's the norm.

Now that I'm no longer beholden to eBay's well-known mystery and secrecy, I'm more than happy to share a few of the interesting tidbits I acquired over the years.

There's a credibility killer right there.

Confidentiality clauses in employment contracts can survive the cessation of employment ... and in the case of eBay and Paypal, I fully expect the consequences of breaching those clauses would be somewhat oppressive.

This simply means that anything any 'ex-employee' is likely to share is not going to be outside what eBay is happy for us to know.  Since we already have strong indications of 'dirty laundry', they are going to let a couple of 'flaws' be shared so as to make it seem as though they have been 'discovered'.... and, as part of that, they can even play those things down by saying something like:

But, bear in mind that a “non disclosure” contract has no force in law as far as the disclosing of criminal conduct is concerned. So, anything any eBay employee is able to tell us about unscrupulous activity by eBay, such as the selective ignoring of breaches of the UA by particular users only and eBay’s deliberate ignoring of (and thereby encouraging of) various forms of known frauds on users, may not be protected by such contracts. Or at least eBay’s pursuing of such a person is unlikely as eBay prefers to ignore such matters as they don’t want their unscrupulous behaviour to be given any more publicity than is at all possible.

But, bear in mind that a “non disclosure” contract has no force in law as far as the disclosing of criminal conduct is concerned.

Aside from the fact that eBay and Paypal happily dance around the rim of the legal minefield - where there is a painful gap between allegation and successful prosecution, you can bet your boots they will have made it very clear that they will 'defend' any such comments that are offered for public viewing (as distinct from evidence given at trial where details can be gagged) ... and that the legal cost for the (ex) employee will be crippling.  Sucking big money from ordinary people that just don't have it, is a somewhat powerful motivator.

While ignoring the 'noise' is one way they weaken credibility of claims, if there were something of substance that was 'let out of the bag' I have no doubt it would be addressed with great speed.
