Title: Help with a paypal "not as described" dispute
Post by: Bellagina on May 14, 2009, 08:57:52 PM
Ok.. I got a doozy today!

As you may (or may not) know, I import Tupperware form the USA and onsell. All been going great til today!
This evening I received an email from Paypal , one of my buyers has opened a "significantly not as described" dipute. I will post her allegations below

Found these in cheap shop your selling them as made by tupperware with wording written all over nothing on the item if Can you prove this is tupperware thats fine if not i am Requesting a refund of $8.70 beacause it only worth the difference or will escalate the claim of the full amount and pay pal take the whole amount.

I have begun an email stating that yep, they are real Tupperware ones, as stated on the packaging, but like most of these sorts of items, are not actually made in a Tupperware owned factory. Any suggeestions from you wonderful RT folk?? BTW - check listing 140320678373 - this is another of these items.

Hi Bellagina,

I think the best thing to do would be to refund the buyer the $8.70 then put them on your BBL list. I would rather pay the refund than go through any more angst. Unfair situation I know.

Hi Bellagina,

Is there a Tupperware web site you can direct them to which shows the item?

You could ring paypal and ask what you need to do to show paypal it is a tupperware item.

From the little I understand about Tupperware the items have identical markings regardless of what market they are for.

The only difference between Asian, US or any other market is the colours used for the plastic.

It is up to you on how you wish to handle it, but another way may be to ask them to return it to you (maybe offer to pay half the return cost)  and you will refund it.

I have had buyers want to keep a product, but get a discount on it after they have taken prosession of it and they have said it is not as described to justify this.  When I have offered to refund on return, they have suddenly changed their mind and not wanted to send it back because they actually like the product.  I had one person tell me the item was their favorite and they wore it every day and couldn't part with it.

Thanks for those suggestions ppl - I have found a link ( for deleted items, that was difficult!) and sent it on, and will ring paypal in the morning.
Buyer had said she was really happy with this item- so I am befuddled.

Bellagina, is it possible your buyer is thinking in terms of testing the waters with claiming items to be fake?

You've probably done the best thing by passing on the link, and there have been some excellent answers already given. I suppose you could contact the buyer again and state you're perfectly prepared to refund the money and have the item sent back... If you word it along these lines, perhaps?

Dear buyer,

I'm so sorry you feel unhappy with the item. I can assure it's a genuine Tupperware piece, and I can of course supply PayPal with the information from Tupperware demonstrating its genuineness. If you do still feel unhappy with your purchase, I have no hesitation in offering you a full refund. Simply return the item to me (you'll need to send it by registered mail) and I will refund the full amount including the return postage. I don't want any of my buyers to feel dissatisfied with the quality of their purchases, and I am sorry you feel in any way dubious about this item which is, as stated, perfectly genuine.

Please let me know if you decide to return this item.

Yours sincerely,
[name]

It's certainly possible that, if your buyer realises you're prepared to back the genuineness of the product but that you have the excellent customer service to offer a refund upon return, she'll realise the dispute is not going to pay off. It sounds to me as though the buyer is trying for a discount after the fact...

No problem - I've had occasion to call them a few times.

1800-073-263

6.00 a.m. to 10.00 p.m. Monday to Saturday AEST

Have your details ready to identify yourself, as per this page: https://www.paypal.com/au/cgi-bin/webscr?cmd=_contact-phone

And - I'd advise having a cup of coffee handy.

Thanks for that countess, after asking here, I had another hunt through the paypal site and eventually found the number myself.
I was hoping there would be a link from the actual dispute, that I could email my information through to paypal, but I could only find a link to the buyer there.

*sigh*

ah well, I wasn't planning on doing too much tomorrow afternoon anyways.... a few productive hours on the phone to paypal will pass the time!

I also think the buyer is purely after a discount. Sorry to disagree with anyone but I'm thinking along the lines of what countess said. Ask them to send it back and you'll refund. That's what they would have to do in an escalated Paypal claim anyway!

*Don't refund until you have the item though!

Aww thanks fellas! I'm overwhelmed by your expressions of support! :green:   :thanks:

It's all gone well, my highly disjointed and rather rambling email to the buyer has worked - she has closed the dispute. I do think that she knew she would have lost out anyway, once I produced the website link to paypal.
And she saved me an afternoon on the phone!  :blah:

It was a rude shock though! My first EVER paypal dispute - I guess I have been really lucky.

I do know where I will come for information/help/a shoulder to cry on next time I have a problem!

You Oz RTers are just :t2: amazing!

Yep - they most certainly do.
However, as I am not an *authorised consultant *(ahem)...
I'd suggest looking Tupperware up in the phone book and ringing them there! They should then organise for someone to contact you.

I used to do the party plan thing in RL about 10 years ago, it was just a set of odd circumstances and perchances that linked me up with my supplier / consultant in the USA, and started me selling the imported stuff on ebay!
