ELKO – After hours of trying to reach a consensus Friday, jurors trying Ron Culley for shooting a man in the foot couldn’t break a deadlocked vote, and District Judge Nancy Porter ruled a mistrial.

Culley, 56, claimed he was attempting to defend himself on Dec. 20, 2013, from a possible attack by firing a few warning rounds into the ground when a stray bullet pierced the left foot of Lester Alderman, his alleged assailant.

Alderman said at trial that he was angry Culley had been spreading rumors he was a thief. He said he gave Culley an ultimatum to fight it out or forget about it.

According to the victim, who said last week he feels lingering pain from the wound, he didn’t want to fight Culley that night and was ready to turn back and go inside the Montello bar when bullets started flying.

Culley said he was surrounded by Montello townsfolk who wished him harm and aimed to take advantage of him.

The jury was evidently unsure.

Having been in police custody since his arrest last year, Culley was granted release under a few conditions: He is not allowed to visit Montello without a law enforcement officer escort, he is not allowed to handle a gun, and Culley must check in weekly with his court-appointed attorney, Gary Woodbury.

Before deliberation began, Deputy District Attorney Tyler Ingram reminded jurors Culley’s allegations against Alderman were not on trial, and neither were other claims of wrongdoing against the defendant.

“We’re not here to decide whether (Culley) was bullied, or whether he was broke, or whether he had no friends,” Ingram said. “… We’re here to decide whether he shot Mr. Alderman in the foot and whether he did so unlawfully.”

The prosecutor argued that the evidence supported a charge of battery with the use of a deadly weapon resulting in substantial bodily harm – which if convicted, can land a defendant in prison for up to 15 years.

Woodbury asked jurors to consider the accuracy of Alderman’s testimony in light of conflicting accounts, such as Alderman’s claim that he wasn’t intoxicated compared with another witness who testified he was.

The jury was sequestered for about seven-and-a-half hours Friday.

In a mistrial, prosecutors can decide whether to try a defendant again with a new jury.

It certainly seems ridiculous for Mr Culley to have been charged with attempted murder in the first instance. Had I a pet chihuahua, its aim would have been better than that purported to be Mr Culley's if he'd actually been attempting to kill Mr Alderman. There are no vital organs in the foot.
It seems sensible for Mr Culley not to be permitted to handle a gun, but I agree that it seems "time served" is adequate for what occurred.

At least he is now out ,12 mths served in the slammer is well and truely enough Pistofforius will be out after 10 months he deliberately shot to kill and did, What people seem to be forgetting here is even the shot that struck Alderman (the 3rd shot) it still ricocheted off the ground before striking him , the original charge of attempted murder was a joke and the charging officer should be sacked for being a pud puller , Felony - not guilty , misdemenour -guilty, time served adequate. game over

Quick kill, easy cleanup
Had some rats chew through my hurricane supplies in my garage. Put three of these Tomcat traps in various areas. Found the sweet spot where the entry hole into my attic is. 4 rats dead in 24 hours same trap. Three rats in a 4 hour span. That included one trap killing two rats at once. Baited it with peanut butter. Clean up is easy, never had to touch the rats just opened the clamshell and the dead rats just drop out. It's a quick kill, I heard the trap go off and was up there about a minute and a half and the rat was lifeless. Thanks for making it so easy.

Ukraine and the Russian invasion

Did any of you see Mr Zelenskyy's address to the Australian parliament yesterday?

What comes across - quite apart from the horrific situation in which the Ukrainians find themselves, amidst the relentless and deadly attacks by the Russian military - is how astute the Ukrainian president is. He tailors his address precisely attuned to his audience. The wording, the situational examples, the inclusion of particular elements, and of course his attire and demeanour - all very carefully used in his speech. He's passionate, articulate, controlled. There is no doubting his emotional strength and courage.

He used the incident of the downed plane MH17 as a starting point, and - with considerable validity, I think - pointed out that because Russia got away with their involvement in that incident, Putin's belief that he could act with impunity was solidified.

He compared the sense of laissez-faire which Russia had/has in invading Ukraine with what other countries with similar authoritarian and territory-grabbing views might have. In other words, without actually mentioning China, he was referring to China - and the timing couldn't have been better, what with the Solomon Islands/China military treaty such a contentious and current point.

His requests for help were on-point.

One of the commentators upon that speech did raise a potential issue - in that Ukraine's forces are losing some military equipment to Russian forces (I can't remember if it was Russian separatists in the Ukraine or if it's Russian's military in the Ukraine who - it was stated - were appropriating Ukraine's equipment). We don't want Australian military vehicles being appropriated by the Russians... but I am a little surprised by the comment as most of the news suggests that Ukrainians are seizing more equipment from the Russians than vice versa. At any rate, if Australia can help with more equipment, I would like us to do.

OK, long time part-timer here. So, am I missing something? BB did just fine for decades when there were NO airbnbs, so why won’t it do fine again when the number of airbnbs are just reduced?

Theodore Buckley short term rental caps are completely normal in most all resort communities and work successfully.
Unfortunately our city officials chose not to implement a cap, and continued, and still continues,to hand out vacation rental licenses like candy. It's too late at this point to implement a cap that would instantly solve the rental problem.
Our city officials need to step up and provide affordable long term rental housing for full time renters like myself,and many others who live and work up here and keep this mountain operating.
There are finance programs that will financially assist our city officials in building affordable full time housing. Tahoe is currently using the assistance funding and building affordable housing,no excuse in the world why our city is not doing the same in an attempt to resolve the problem they consciously created.
Maybe instead of being divided and misled,the residents of Big Bear Lake should come together and insist that their city officials do their job🤔just a thought.

Shawn Early I'm not sure what you mean by for real? And I've only been up here working and renting for going on 20 years. I've been in the property management field for over 40 years and I've spent most of my life either living in and or working in some of the largest Resort communities in California. so I'm only speaking from my personal experience and research, as well as what I've experienced with how things work up here via the city officials.

Dee Levey I was agreeing with you.....they let these strs' get out of control...now I'm not sure how this will pan out, but the housing issue MUST be addressed...i own my home , but have watched many friends lose their home and regretfully leave town..p.s. I also work in this industry...

Shawn Early on one hand it's absolutely crazy what the city officials have allowed to happen. and you and I both know it has nothing to do with anything other than greed on their part.
On the other hand it's heartbreaking watching all these families and workers lose their homes and have to move off the mountain which in turn has left numerous businesses up here including the Resort's short-handed.
And what strikes me as very odd, but par for the course, is you and I and many other residents see exactly what's going on yet our city officials continue to sit in their chairs staring off into space like they have no clue😂😂😂
it's maddening at best. and then on top of all this we have this insane division that has been unnecessarily created within our community buy one individual who sits in a City Council seat and since day one has made it his mission play the community of Big Bear Lake for a bunch of fools. while in fact he is purposely creating a division to keep everybody in our community fighting with each other so that they're not really paying attention to what's actually going on😮 it's the craziest thing I've seen in my lifetime other than Jim Jones and the drinking of the Kool-Aid and Charles Manson and Helter Skelter what's happening in Big Bear Lake is if nothing else Insanity at its finest. Now we've made the news because of what this guy is doing and yet there is still a handful of people that follow him like Blind Mice and continue to create unnecessary chaos in a community where it's not even necessary.
If we would all relax and take a deep breath, do a little research and by that I mean real research and wake up. we need to come together not be divided and we certainly don't need to allow some man who can't even figure out where he actually lives to divide us😂
I don't like thinking about the future because I have a feeling the city officials are going to do everything in their power to avoid taking their responsibilities in all this and start stepping up and fixing the problem which they can easily do as I mentioned in an earlier response Tahoe is doing what needs to be done to correct this type of situation so there's no excuse in the world why Big Bear Lake isn't doing the exact same thing. but instead even today our city officials continue to hand out vacation rental licensing.
Maybe all these residents that are busy trying to fight each other should come together and actually stand up to the city officials and make them do their job and fix this mess before it truly becomes unfixable😢 one positive thing I'm watching our City Council people, our mayor, and City attorney,and city manager actually coming together quickly to try to purge Alan Lee from the city council before he does more damage. and the faster they do that the better for every single one of us who live up here no matter what side of the fence we may be on because that guy is playing a lot of people for fools and he's doing quite a good job of it sadly.😢

Theodore Buckley Big Bear has always had vacation rentals at least for the last 20 years that I'm aware of or I wouldn't have been up here at all because I work in the property management industry and I manage full-time and short-term rentals.
the difference now is Airbnb has become such a large venue that everyone who owns vacation rentals as well as the brick-and-mortar management businesses are using Airbnb. so they stand out like a sore thumb with the overabundance of vacation rentals we have up here right now thanks to our city officials handing out vacation rental licensing like candy.
Prior to Airbnb being implemented we all did our own advertising or we used GoDs
venues like VRBO.
but Airbnb blew up and they blew up in a big way and the sad part about that is even though they're everywhere they very rarely defend the property owners and they always take the side of the guest no matter how rude, no matter how destructive, no matter how many rules they break Airbnb always sides with the guests and one would think these vacation rental owners would see this and do something about it. but apparently the exposure means more to them then doing the right thing or the five star super host rating overshadows good property ownership and self respect. I personally do not like Airbnb but if that's what my clients use then I have to go along with the program.
But Airbnb is not the problem up here Airbnb is simply a venue people advertise on. We need to start focusing on where the real problem is and put all this negative and positive energy into addressing those responsible for it and insisting they do their job and remedy the situation or vote them out of their position and put someone in the position that knows what the hell they're doing and cares about the community over how much money they can stuff in their own Pockets at the expense of the community.

I just wanted to thank everybody in this group for treating each other with respect and being kind to one another no matter what side of the issue they may or may not be on.
It's tough when things like this happen in a community and people are misled by an individual they trusted, especially an individual who is on our city council and led us all to believe that he had our best interest at heart. And unfortunately because of the actions of this individual and his handful of followers within the citizens initiative group things have been Twisted so badly that unless you do hours upon hours of research it's difficult to dig through all the BS and get to the truth of the matter. So a huge thank you to everyone for being respectful and kind.

Fill the lake

My opinion on the story about the proposed aquatic center. Instead of spending 29+ million on an aquatic center that will benefit less than 1% of local residents, put the money towards building the promised water reclamation facility that will benefit every resident. I would like to see our lake full again at least once before I die.

Ed: Our lake is a natural lake. In my lifetime I've seen it "full" twice. Being "full" does not mean squat. We have plenty of acres of water to enjoy. Our current lake level is more normal from my years being in Big Bear, going back to 1954. I don't know where this perception that Big Bear Lake does not exist unless it's full. Note: The marinas did not even push the docks out last year. No one was deprived of any water sport or enjoyment.
